SA Eesti Vabaõhumuuseum, with the Registry Code 90012585, at the address Vabaõhumuuseumi rd. 12, Tallinn 13521 (hereinafter the Service Provider) and a client, who places an order at the e-shop and identifies him/herself by entering of his/her personal data in the order form (hereinafter the Service User), have concluded this e-shop user agreement (hereinafter the User Agreement).
1.1. The e-shop of SA Eesti Vabaõhumuuseum (hereinafter the E-Shop) shall be the online shop created by the Service Provider, through which the sale of products to the Service User shall be carried out. (NB! Transaction shall be made to the bank account of the Ministry of Finance.)
2. GENERAL PROVISIONS
2.1. Upon regulation of the relations between the Parties to the Agreement, the Parties shall be guided by the Law of Obligations Act, other laws and legislation of the Republic of Estonia and the agreements in the User Agreement.
2.2. The Service Provider shall have a right to change the provided E-Shop services at any time.
2.3. The Service Provider shall have a right to unilaterally amend the terms and conditions of the User Agreement without being required to inform the Service User thereof in writing by e-mail.
3. PRODUCTS AND PURCHASES
3.1. The products displayed at the E-Shop are normally present in the warehouse. Availability of products displayed at the E-Shop may change due to technical issues in the warehouse or E-Shop programs.
3.2. In case the product is missing from the warehouse and it is impossible to perform the order, then the E-Shop employee shall contact the user and the money shall be refunded to the user immediately, but not later than within 14 days after placing the order.
3.3 The products offered at the E-Shop shall be sold to both natural persons and legal persons.
3.4. The Service User confirms that he/she is at least 18 years old.
3.5. The Service User shall select the desired products and enter data required for the performance of the order (given name, surname, contact phone number, e-mail address, delivery address, postal code) and pay for the products by using the bank link of the internet bank.
3.6 The Service User shall submit correct data that is necessary for the performance of the order, while formalizing the order. The Service Provider shall not be held liable, upon performance of the order, for failure to perform the order or any consequences arising thereof that is caused by the incorrect data submitted by the Service User.
3.7. Sale shall be effected after the Service User has sent an order through the website of the E-Shop and paid for the order and received an e-mail confirmation during the purchase.
4.1. All prices at the E-Shop are in euros and are inclusive of the value added tax.
4.2. The Service Provider shall have a right to amend the prices displayed at the E-Shop at any time. In case the prices are amended after the Service User has placed an order and paid for it, the Service Provider shall deliver the respective products to the user for the prices that were effective at the time the order was placed. The Service Provider shall have no right to demand a compensation for the price difference.
5. DELIVERY TIME AND DELIVERY CONDITIONS
5.1. The transport costs for the Service User, irrespective of the weight, shall be 4€ within the Republic of Estonia
16€ within the European Union
25€ in the case of the United States of America
The United States of America and countries that are not separately mentioned in the list of countries of delivery at the E-Shop shall send the purchase order to the e-mail firstname.lastname@example.org, by specifying the desired goods, volumes thereof and personal data. The Service Provider shall send the sales invoice to the Service User and despatch the goods ordered by the Service User to the Service User after payment of the invoice.
5.1.1. The goods shall be sent to the address specified by the Service User as a standard parcel through Omniva (Eesti Post).
5.2. After conclusion of the sale transaction (Clause 3.7), the seller shall despatch the goods to the address specified in the order within 7 working days.
6. WITHDRAWAL FROM THE AGREEMENT
6.1. In case the Service User wishes to withdraw from the agreement after placement of the order, the Service User shall inform the Service Provider thereof within 14 days in writing. The written notice shall be sent to the e-mail address email@example.com, by indicating the order number which the Service User wishes to withdraw and add contact details of the Service User (given name, surname, date of placement of the order, contact phone number).
6.2. In case the application for withdrawal reaches the Service Provider after the Service Provider has despatched the goods, then the withdrawal from the agreement shall take place pursuant to the chapter "Right to Return" of the E-Shop User Agreement 6.3. The Service Provider shall transfer the amount paid, including the transport costs, to the Service User within 14 days from the arrival of the returned goods to the address of the Service Provider.

6.4. The money shall be transferred to the same bank account, from where it was transferred to the Service Provider.
7. RIGHT TO RETURN
7.1. The goods purchased from the E-Shop shall be subject to the right to return within 14 days.
7.2. The returned product shall be without deficiencies, complete, in the original packaging and unused.
7.3. The right to return shall not be extended to audio and video recordings, which wrapping is opened.
7.4. To return the product, an application for withdrawal shall be sent to the e-mail firstname.lastname@example.org
7.5. In the case of withdrawal from the Agreement, the Service User shall immediately, but not later than within 14 days from notification of the withdrawal from the Agreement, return the purchased item.
7.6. In the case of implementation of the right to return, the purchase price and the delivery charges shall be transferred to the Service User not later than within 14 days from the receipt of the goods by the Service Provider.
7.7. The money shall be transferred to the same bank account, from where it was transferred to the Service Provider.
7.8 The Service User shall bear the costs of returning the goods in the sum of 4 euro within Estonia, 16€ within the European Union and 25€ within the United States of America, unless the returned product failed to comply with the order of the consumer.
7.9 The 14-days-right of return shall not be applicable with respect to the following goods: products that are manufactured by taking into account the personal needs of the Service User, as well as audio and video recordings, which wrappings the Service User has opened.
7.10 In case it appears after returning the product that the product fails to comply with the conditions stipulated in Clauses 7.1 - 7.4. of the E-Shop User Agreement, the money shall not be refunded to the Service User and the returned product shall remain in custody at the Service Provider. The Service User shall bear the costs related to warehousing of the product or returning the product to the Service User.
8. PROCEDURE FOR PRESENTATION OF COMPLAINTS
8.1 The products sold from the E-Shop shall be subject to a 2 years’ time limit for submission of complaints as stipulated in Section 218 (2) of the Law of Obligations Act.
8.2. Processing of complaints shall take place pursuant to the procedure for processing of complaints.
9. PERSONAL DATA AND USE THEREOF
9.1. The Service User shall grant a clear and enlightened consent to the Service Provider for processing of his/her personal data.
9.2 The personal data of the Service User entered by the user upon placement of an order that has became known to the Service Provider, shall be entered in the registry of clients and used for the provision of sales services and for offering of goods to the Service User.
9.3 A source of the personal data is the creation of a client relationship upon registration of the order at the E-Shop.
9.4 The personal data to be registered shall contain data concerning the order of the Service User: given name (given names), surname, phone number, e-mail, street, house/apartment, city/settlement, postal code, agreement with the purchase conditions of the E-Shop, consent to receive offers for sale at the e-mail address.
9.5. SA Eesti Vabaõhumuuseum with the Registry Code 90012585, at the address Vabaõhumuuseumi rd. 12, Tallinn, shall process the personal data.
9.6 The personal data of the Service User that are necessary for mediation of the goods to the Service User shall be forwarded to the undertakings providing courier services.
9.7. Protection of the personal data shall be ensured by all statutory security measures.
9.8 The Service Provider shall not forward the registered personal data to unauthorised parties.
9.9 The Service Provider reserves the right to forward personal data of the Service Provider to persons who have a respective legitimate right and who process the data to perform their legal obligation and to persons, who have a respective legitimate right and in case it takes place for the protection of life, health or freedom of the Service User or third party.
9.10 The Service User shall have a right to check his/her personal data, also amend such data or request removal of his/her personal data from the registry.
9.11 The Service User shall grant to the Service Provider a consent to receive an order confirmation at the e-mail address entered upon placement of the order.
10.1 The liability of the Service Provider shall be limited to the sale price of the product. The Service Provider shall not assume liability for defects, which the purchaser has caused to the product.
10.2 The Service User shall use the E-Shop service only in compliance with laws and good practices.
10.3 The Service User shall be held responsible for all expenses that are related to obtaining and maintenance of data communication systems of software of the devices that are necessary for use of the E-Shop service, as well as other expenses caused by the use of the E-Shop service.
10.4 The Service User shall be held entirely liable for all damages caused to the Service Provider, other service users or third parties by the use of the E-Shop in a manner contrary to the terms and conditions of the E-Shop User Agreement or contrary to the laws or good practices.
11.1 The disagreements arising from the E-Shop User Agreement between the Service User and the Service Provider shall be settled pursuant to the legislation effective in the Republic of Estonia. In the case of failure to reach the agreement, the disagreements shall be resolved by the Consumer Protection Committee.
